1. About these Terms
VirtualWorkers.Asia is operated by Online Technology Australia (“VirtualWorkers.Asia”, “we”, “us” or “our”).
By using this website, creating an account, posting a job, creating a worker profile, purchasing a subscription or otherwise using our services, you agree to these Terms of Use and our Privacy Policy.
If you do not agree to these Terms, you must not use the platform.
2. What VirtualWorkers.Asia Does
VirtualWorkers.Asia is an online marketplace that enables businesses and individual remote workers to find and communicate with each other.
VirtualWorkers.Asia does not employ workers, supervise or direct their work, set wages or employment conditions, pay worker remuneration, or become a party to any agreement between an employer and worker.
Employers and workers decide for themselves whether to work together and agree directly on matters including:
- duties and responsibilities;
- pay;
- hours;
- working arrangements;
- employment or contractor status; and
- any other terms of their working relationship.
VirtualWorkers.Asia does not guarantee that an employer will find a suitable worker or that a worker will obtain work.
3. Your Account
You must:
- provide accurate and current information;
- keep your account information up to date;
- keep your login details secure; and
- promptly notify us if you believe your account has been accessed without permission.
You must be at least 18 years old and legally capable of entering into a binding agreement.
Accounts must not be sold, transferred or shared with another person or business without our permission.
You are responsible for activity carried out through your account.
4. Workers
Creating a worker profile and applying for opportunities is free.
VirtualWorkers.Asia does not charge workers a fee to be listed, apply for work or be hired.
Workers must ensure that information provided through the platform is accurate and not misleading, including information relating to:
- identity;
- qualifications;
- skills;
- work history;
- experience; and
- assessments or verification checks.
Workers are responsible for deciding whether an employer and opportunity are suitable for them.
Workers should agree on pay, duties, hours and other working conditions directly with the employer before beginning work.
5. Employers
Employers may be required to purchase a subscription or other paid service to access worker profiles, contact information or other platform features.
Current pricing is shown on our pricing page and at checkout.
Worker information provided through VirtualWorkers.Asia may only be used for genuine hiring purposes.
Employers must not:
- harvest worker information;
- resell or distribute worker information;
- use worker information for unsolicited marketing;
- post false or misleading opportunities; or
- use the platform for unlawful or discriminatory purposes.
Employers are responsible for determining whether a worker is suitable for their business and for carrying out any additional checks they consider necessary.
Employers are also responsible for complying with laws that apply to their engagement of a worker, including any applicable requirements relating to employment, contractors, wages, taxation, payroll, working conditions, insurance, workplace safety and privacy.
6. Employer and Worker Relationships
Any agreement for work is made directly between the employer and worker.
VirtualWorkers.Asia is not responsible for:
- the performance of a worker;
- the conduct of an employer;
- the quality of work performed;
- payment of wages, fees or other remuneration;
- employment disputes;
- contractor disputes;
- tax or payroll obligations; or
- the terms agreed between an employer and worker.
Employers and workers are responsible for resolving disputes arising from their working relationship.
7. Payments and Subscriptions
Fees for VirtualWorkers.Asia services are displayed at checkout.
Paid services are billed in advance for the selected subscription period.
Where a subscription automatically renews, the renewal terms, billing period and price will be shown before purchase.
Subscriptions continue until cancelled.
You may cancel a subscription at any time. Cancellation will take effect at the end of the current paid subscription period unless stated otherwise at checkout.
Fees already paid are generally non-refundable where the service has been made available to you, except where a refund is required by law.
Nothing in these Terms excludes rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.
8. AI Resume Review
VirtualWorkers.Asia may offer tools that use artificial intelligence to provide feedback on resumes, CVs or other career information.
AI-generated feedback may contain errors, omissions or incorrect recommendations.
It is provided as general information only and does not constitute professional career, recruitment or employment advice.
VirtualWorkers.Asia does not guarantee that using the tool will result in employment, interviews or other outcomes.
You must only submit information that belongs to you or that you have permission to use.
9. Verification and Screening
VirtualWorkers.Asia may provide verification checks, assessments, screening results or indicators relating to workers.
These may include areas such as:
- identity;
- English capability;
- internet connection;
- skills; or
- other profile information.
Verification or screening is intended to assist users but is not a guarantee of identity, ability, suitability, qualifications, character or future performance.
Employers remain responsible for carrying out their own due diligence before engaging a worker.
Workers must not manipulate, falsify or attempt to circumvent any assessment or verification process.
10. Acceptable Use
You must not use VirtualWorkers.Asia to:
- break any applicable law;
- arrange unlawful work;
- post false, misleading or fraudulent information;
- impersonate another person or organisation;
- infringe another person’s intellectual property rights;
- scrape or bulk-download platform information;
- send spam;
- distribute malware;
- interfere with the operation or security of the platform;
- circumvent access controls or paid features;
- misuse another user’s personal information; or
- engage in harassment, abuse, fraud or other harmful conduct.
We may remove content or restrict accounts where we reasonably believe these Terms have been breached.
11. Content and Intellectual Property
You retain ownership of content you upload to VirtualWorkers.Asia, including profiles, CVs, job advertisements and other materials.
You grant VirtualWorkers.Asia a non-exclusive licence to host, store, reproduce, display and distribute that content as reasonably required to operate and promote the platform.
For example, this allows us to display worker profiles to employers or job advertisements to workers.
The VirtualWorkers.Asia website, software, branding, design and original content belong to us or our licensors and must not be copied or reproduced without permission.
12. Third-Party Services
VirtualWorkers.Asia may integrate with or link to third-party services including payment providers, cloud storage services and other technology providers.
Those services are operated independently and may have their own terms and privacy policies.
We are not responsible for third-party services outside our reasonable control.
13. Suspension and Termination
We may suspend, restrict or close an account where we reasonably believe:
- these Terms have been breached;
- fraudulent or unlawful activity has occurred;
- another user may be at risk;
- payment obligations to VirtualWorkers.Asia have not been met; or
- the account creates a security or operational risk.
You may close your account at any time.
Provisions that are intended to continue after account closure, including intellectual property, liability, indemnity and dispute provisions, will continue to apply.
14. Liability
VirtualWorkers.Asia provides the platform with reasonable care and skill but does not guarantee that the service will always be available, uninterrupted or error-free.
To the maximum extent permitted by law, VirtualWorkers.Asia is not responsible for loss arising from:
- the conduct of an employer or worker;
- a decision to hire or work with another user;
- worker performance;
- non-payment by an employer;
- disputes between users;
- information provided by another user;
- third-party services; or
- events outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any right, guarantee or liability that cannot legally be excluded.
Where our liability can lawfully be limited, our liability will be limited, at our option, to resupplying the affected service or the amount paid to VirtualWorkers.Asia for that service during the previous 12 months.
15. Indemnity
To the maximum extent permitted by law, you agree to indemnify VirtualWorkers.Asia against claims, losses, liabilities or reasonable costs arising from:
- your breach of these Terms;
- your unlawful use of the platform;
- information or content you provide;
- your employment, contractor or working relationship with another user;
- your failure to comply with laws applicable to you; or
- your infringement of another person’s rights.
This section does not require you to indemnify VirtualWorkers.Asia for loss caused by our own unlawful conduct.
16. Changes to These Terms
We may update these Terms from time to time.
The date at the top of the Terms will show when they were last updated.
Where a change is material, we may provide notice through the platform or by email.
Changes to paid subscription arrangements will generally apply from the next subscription period unless a change is required earlier for legal, security or operational reasons.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
The courts of New South Wales have jurisdiction in relation to disputes arising under these Terms.
Nothing in these Terms excludes any right or obligation that cannot lawfully be excluded under applicable law.
